Balance Masters Warrants their balancer to be commercially free from any defects in material and workmanship. This warranty shall remain in effect for the life of the balancer but shall not extend to any equipment that has been affected by damage or wear resulting from misuse, abrasion, corrosion, negligence, accident, tampering, faulty installation, inadequate maintenance, damage, casualty, or any other reason. This warranty shall also not extend to equipment that has been repaired or altered in any way that affects the condition of the balancer.
This warranty is conditioned upon the PREPAID RETURN of the balancer claimed to be defective. Balance Masters will be the final judge as to the condition of the balancer claimed to have been defective. If the claimed defect is valid, Balance Masters will Replace FREE of charge any defective parts. The balancer will be returned to the original purchaser transportation prepaid. If inspection of the balancer does not disclose any defect in material or workmanship, the balancer will be refinished at a reasonable charge, which charges may include the cost of labor and transportation. In no case shall Balance Masters liability exceed the amount of the purchase price.
The buyer shall give Balance Masters immediate notice of any claim to be made under this warranty. The buyer must contact Balance Masters at 1 (800) 786-8324 ) for a RETURN AUTHORIZATION NUMBER before returning any parts to the factory. This warranty is also conditioned upon the RECEIPT OF A VALID WARRANTY REGISTRATION CARD. The balancer should be shipped PREPAID to Balance Masters, 19428 Business center Dr #A Northridge, CA 91324, and should be clearly marked with the RETURN AUTHORIZATION NUMBER. Shipments that are received WITHOUT A RETURN AUTHORIZATION NUMBER WILL NOT BE ACCEPTED. NO OTHER LOCATIONS ARE AUTHORIZED TO COVER WARRANTIES.
THE BUYER’S EXCLUSIVE REMEDY AGAINST Balance Masters FOR THE BREACH OF ANY OBLIGATION UNDER THIS SALES CONTRACT, WHETHER DERIVED FROM WARRANTY OR OTHERWISE, SHALL BE LIMITED, AS SPECIFIED HEREIN, TO REFINISH OR REPLACEMENT ARE AT BALANCE MASTERS SOLE OPTION TO REFUND. Balance Masters shall not be liable for any other damage or loss, including but not limited to incidental or consequential damages for injury to persons, products, contents of buildings, or any other property, or lost profits or loss of sales, or for any other direct, incidental or consequential loss.
THIS WARRANTY SHALL BE EXCLUSIVE AND SHALL BE IN LIEU OF ANY OTHER WARRANTY, WRITTEN OR ORAL, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF EITHER MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
